Introduction

These Terms and Conditions ("Terms") govern your access to and use of the QuickBid platform, including the website [www.quickbid.co.in], its mobile application, and all services offered therein (collectively, the "Services"). These Services are operated by QuickBid Systems Private Limited ("Company", "QuickBid", "We", "Us", or "Our"). By accessing or using our Services, you agree to be legally bound by these Terms. If you do not agree, you must not access or use the Services.

License and Scope of Use

QuickBid grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for internal business purposes only. You shall not:

  • Reverse-engineer, scrape, or replicate any content or technology on the platform
  • Use automated tools (bots, scripts) to extract data
  • Share your credentials or provide multi-user access under one subscription

User Obligations

You agree:

  • To provide accurate and complete information during registration
  • To comply with applicable Indian laws and data usage regulations
  • Not to resell or sublicense QuickBid services without written consent

Fees, Payments & Refunds

  • All services are prepaid and non-refundable once activated.
  • Payments can be made via Credit/Debit Cards, UPI, Net Banking, or other methods offered.
  • In rare cases of service disruption caused solely due to QuickBid's internal technical failures, the Company may, at its sole discretion, offer service extensions as a gesture of goodwill.
  • Notwithstanding the foregoing, if QuickBid is ever held legally liable to a subscriber, the maximum liability of QuickBid, if any, shall be strictly limited to the pro-rata value of the subscription fee paid by the Subscriber for the specific billing cycle during which the cause of action arose, calculated from the date the claim is formally notified to QuickBid.

Note: Refunds are not permitted in case of missed tenders, delayed updates, or incorrect user-entered information.

Intellectual Property

All content, trademarks, software, and logos on QuickBid are the exclusive property of the Company or its licensors. Unauthorized use, copying, or redistribution is strictly prohibited and may attract legal action.

Fair Usage Policy

To ensure optimal performance for all users:

  • Automated bulk downloading or scraping is prohibited.
  • Usage may be rate-limited to prevent abuse.
  • Email notifications are limited to fair quota per subscription. QuickBid reserves the right to suspend accounts violating this policy and no claims what-so-ever will be entertained post suspension.

Third-Party Links

Our platform may link to third-party websites. QuickBid is not responsible for the content or availability of such sites and disclaims all liability arising from your use of them.

Disclaimer, Limitation of Liability & Indemnity

Nature of Services

QuickBid Systems Pvt. Ltd. ("QuickBid") is an AI-powered assistive platform that aims to facilitate, streamline, and automate the tender bid documentation process by offering features such as document management, automated formatting, tender notifications, and reminders. QuickBid is not a government entity, does not participate in tenders, and does not guarantee tender success, accuracy of tender data, or compliance with tender requirements. The Services provided are solely intended as support tools to improve efficiency and organization in the bid preparation process.

No Guarantee of Error-Free Output

QuickBid does not guarantee that the auto-generated tender bid documents, formats, summaries, or alerts will be completely accurate, error-free, or fully compliant with all requirements of tendering authorities. The final responsibility of reviewing, verifying, and ensuring the completeness, accuracy, and compliance of the bid documents lies entirely with the Subscriber. QuickBid shall not be held liable for any loss, disqualification, or rejection of tenders due to errors or omissions in auto-generated documents or alerts.

System Limitations and Downtime

The Subscriber acknowledges and agrees that from time to time, the QuickBid platform may face technical issues, scheduled or unscheduled maintenance, system outages, cloud infrastructure downtimes, network disruptions, or force majeure events. In such cases, the availability and performance of the Services may be adversely affected. QuickBid does not warrant uninterrupted access and shall not be held responsible for any delay or disruption in service due to technical, financial, or physical causes.

No Refund Policy & Limited Remedy

All subscriptions are non-refundable once activated. QuickBid does not provide refunds or compensation for missed tenders, delayed alerts, erroneous document output, service downtime or user input errors. In rare cases of service disruption caused solely due to QuickBid's internal technical failures, the Company may, at its sole discretion, offer service extensions as a gesture of goodwill. Notwithstanding the foregoing, if QuickBid is ever held legally liable to a subscriber, the maximum liability shall be strictly limited to the pro-rata value of the subscription fee paid by the Subscriber for the specific billing cycle during which the cause of action arose, calculated from the date the claim is formally notified to QuickBid.

Limitation of Liability

In no event shall QuickBid or any of its directors, officers, employees, affiliates, investors or licensors be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost business opportunities, missed tenders, disqualification, or financial losses, even if advised of the possibility of such damages.

Indemnification

The Subscriber agrees to fully indemnify, defend, and hold harmless QuickBid, its parent company, owners, directors, employees, officers, affiliates, agents, investors, licensors, and representatives from and against any and all claims, losses, damages, liabilities, suits, penalties, costs, and expenses (including reasonable legal fees) arising out of:

  • The Subscriber's use or misuse of the Services;
  • Any reliance placed on auto-generated documents or alerts;
  • Any breach of these Terms and Conditions by the Subscriber;
  • Any slow down or downtime in services due to what-so-ever reasons;
  • Any action, complaint, or proceeding initiated by third parties, government authorities, or regulatory bodies in relation to the Subscriber's tendering activity.

Intellectual Property Rights

The website, mobile application, and their content are the copyrighted property of QuickBid and/or its third-party providers. Unauthorised use, reproduction, or redistribution of the content is prohibited. QuickBid grants you a limited, non-exclusive license to use the Software for viewing and using the Services.

The trademarks and logos of QuickBid are the intellectual property of QuickBid and may not be used without prior written permission. All other trademarks appearing on the website and/or mobile application are the property of their respective owners.

Acknowledgement and Acceptance

By subscribing to and using QuickBid's Services, the Subscriber acknowledges, understands, and accepts that QuickBid is a facilitative platform, and not a substitute for human judgment, review, or professional scrutiny. The Subscriber agrees to exercise due diligence in reviewing all documents and data before submission to any third party or tendering authority.

Termination

We reserve the right to suspend or terminate your access without notice if you violate these Terms. Termination does not entitle you to refunds.

Changes to the Policy

QuickBid may modify this Fair Usage Policy at any time without notice. Continued use of the Subscription Package constitutes acceptance of the updated policy.

By using the Services, you agree to comply with these Terms and the Fair Usage Policy. If you have any questions or concerns, please contact QuickBid customer support.

Modifications/Amendments

QuickBid reserves the right to make changes to the website, Services, and these Terms at any time without notice. By continuing to use the website and/or mobile application after such changes are posted, you agree to accept them. QuickBid will ensure that changes do not materially decrease the functionality of Subscription Services.

QuickBid may charge listing fees and transaction fees for certain listings and purchases made using the Services. All fees are subject to change without notice. If there is any underpayment due to technical reasons, QuickBid reserves the right to deduct the balance subsequently.

Payment methods accepted by QuickBid include Indian credit cards, debit cards, internet banking, online wallets, and UPI. Other payment methods may be accepted at QuickBid's discretion. All payments must be made in Indian Rupees.

By booking with QuickBid, you authorise transactions with your bank or other payment gateways to process payments. You are responsible for adhering to the terms and conditions of the payment gateways.

Dispute Resolution & Arbitration

  • All disputes shall be resolved by arbitration under the Indian Arbitration and Conciliation Act, 1996.
  • Arbitrator: Sole arbitrator appointed by QuickBid
  • Venue: Lucknow, Uttar Pradesh
  • Language: English
  • Jurisdiction: Courts of Lucknow shall have exclusive jurisdiction
